Born to a prominent Georgia family, he served in the Georgia legislature while in private practice. He was appointed to the Georgia Supreme Court in 1903, serving for 2 years. He was appointed to the United States Supreme Court in 1911, his nomination coming as something of a surprise. He was little known outside the South and had limited contact with President Taft. He was, however, confirmed after 5 days by the Republican Senate.
