Lot Description

LINCOLN, Abraham (1809-1865). Autograph document, unsigned, [Springfield], 4 August 1841.

One page, 8vo (159 x 191 mm), corner losses strengthened with tissue, discolorations at corners, old folds.

In full: "The plaintiff in this case now prays the answer of Philip S. Kreigh, who has been summoned as a garnishee herein, to the following interrogatories [illegible].
1st - Are you or are you not indebted to Nicholas Bryan?
2nd - What is the full amount of all your indebtedness to said Bryan?
3rd - In what manner, and on what account did you become indebted to said Bryan?
4th - Is or not your indebtedness to said Bryan now due? And if it is not, when it become due?"

Hay v. Bryan was one of Lincoln's first cases after he entered into partnership with Stephen T. Logan. The plaintiff, Nathaniel Hay, sued Nicholas Bryan after Bryan failed to pay the balance of a debt owed for bricks. Among those called was Philip S. Kreigh, who owed Bryan; when Bryan failed to appear in court, the case was decided in Hay's favor, and Kreigh's debt of $40.47 was garnished and awarded to Hay to partially satisfy the debt. Hay would go on to sue Bryan twice more regarding this debt, accusing him of hiding his assets to avoid paying. The court later decided that Bryan was indeed attempting to hide his assets, and the two lots he had bought in his father's name were sold, with the proceeds awarded to Hay.
